AN ORDINANCE REGULATING THE PLACEMENT OF MOBILE HOMES WITHIN THE CITY LIMITS OF KRESS, TEXAS; ESTABLISHING RESTRICTIONS ON THE NUMBER OF MOBILE HOMES PER LOT, AGE REQUIREMENTS, AND SKIRTING REQUIREMENTS; AND PROVIDING FOR A REPEALING CLAUSE AND SEVERABILITY.

BE IT ORDAINED BY THE CITY COUNCIL OF CITY OF KRESS, TEXAS:


 SECTION 1: DEFINITIONS

For the purposes of this ordinance, the following terms shall have the meanings ascribed to them:

1.1 Mobile Home: A manufactured home built on a permanent chassis and designed for long-term occupancy as a dwelling.

 SECTION 2: REGULATIONS ON MOBILE HOMES

2.1 Limit on Number of Mobile Homes: No more than one (1) mobile home shall be placed on a single lot within the city limits of Kress Texas. The placement of additional mobile homes on the same lot is strictly prohibited.
2.2 Age Requirement: All mobile homes located within the city limits must be ten (10) years old or newer at the time of placement. Any mobile home that exceeds ten (10) years in age shall not be allowed within the city.
2.3 Skirting Requirement: All mobile homes must have skirting installed around the base of the home. The skirting must be made of suitable materials that enhance the aesthetic appearance of the mobile home and provide protection from the elements. Skirting must be installed within thirty (30) days of placement.

SECTION 3: ENFORCEMENT

3.1 Violations:  Any person or entity found to be in violation of this ordinance shall be subject to penalties as outlined in the city’s municipal code.

3.2 Inspections:  Authorized personnel from the City of Kress will have the right to inspect mobile homes and related properties to ensure compliance with this ordinance.

SECTION 4: REPEALING CLAUSE

All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed.

SECTION 5: SEVERABILITY

If any provision of this ordinance is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

SECTION 6: EFFECTIVE DATE

This ordinance shall take effect immediately upon its passage and publication as required by law.
