AN ORDINANCE PROHIBITING THE USE OF RECREATIONAL VEHICLES AS PERMANENT HOUSING WITHIN THE CITY LIMITS OF KRESS, TEXAS; PROVIDING FOR DEFINITIONS, VIOLATIONS AND PENALTIES; AND PROVIDING FOR A REPEALING CLAUSE AND SEVERABILITY.

BE IT ORDAINED BY THE CITY COUNCIL OF CITY OF KRESS, TEXAS:

 SECTION 1: DEFINITIONS

For the purposes of this ordinance, the following terms shall have the meanings ascribed to them:

1.1 Recreational Vehicle (RV): Any motorhome, trailer, camper, or similar vehicle designed primarily for recreational or temporary living purposes, including but not limited to travel trailers and fifth-wheel trailers.
1.2 Permanent Housing: The use of any dwelling, including RVs, as a primary place of residence for human beings for an uninterrupted period exceeding  20 days.

SECTION 2: PROHIBITION OF RVs AS PERMANENT HOUSING

2.1 Permanent Residency Prohibition: It shall be unlawful for any person or entity to use a recreational vehicle as permanent housing within the city limits of Kress, TX. No RV shall be permitted to serve as the primary dwelling for any person for more than 20 days in any calendar year.

SECTION 3: EXEMPTIONS

3.1 Temporary Use: The use of RVs is permitted for temporary lodging purposes, such as within designated RV parks, campgrounds, or during special events, provided that such use complies with applicable laws and regulations governing those facilities.

SECTION 4: VIOLATIONS AND PENALTIES

4.1 Violations: Any person or entity found in violation of this ordinance shall be subject to penalties as outlined in the city’s municipal code, which may include fines not exceeding $500.00 per violation.
4.2 Enforcement: Authorized personnel from the City of Kress shall have the authority to enforce this ordinance and issue citations for violations.

SECTION 5: REPEALING CLAUSE

All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed.




SECTION 6: SEVERABILITY

If any provision of this ordinance is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

SECTION 7: EFFECTIVE DATE

This ordinance shall take effect immediately upon its passage and publication as required by law.
