An Ordinance Establishing Regulations Against Illegal Parking within the City Limits of Kress, Texas; Providing for Penalties; and Establishing Enforcement Procedures

WHEREAS, the City Council of Kress, Texas finds that illegal parking poses a danger to public safety, obstructs traffic, and negatively impacts the quality of life for residents; and

WHEREAS, the City Council desires to ensure compliance with both local and state parking laws to maintain order and safety within the City limits of Kress;

NOW, THEREFORE, be it ordained by the City Council of Kress, Texas:

Section 1: Purpose
The purpose of this ordinance is to regulate parking within the city limits of Kress, including the enforcement of state law regarding parking, specifically addressing improper parking in alleys, public rights-of-way, and other prohibited areas.

Section 2: Definitions
For the purposes of this ordinance, the following definitions shall apply:
- Illegal Parking: Parking a vehicle in violation of any posted signs or markings, or in any area where parking is prohibited by state law or city ordinance.
- Alley: Any public thoroughfare that is not a street, designed to provide access to the rear or side of properties.
- Vehicle: Any motorized or non-motorized conveyance that is capable of being driven or parked on public roads.

Section 3: Prohibited Parking
1. No person shall park any vehicle in the following areas:
- Within 15 feet of a fire hydrant.
- On any public sidewalk.
- In any marked crosswalk.
- Within an intersection or on a bridge.
- In alleys, except as permitted for delivery or access purposes, and provided such use does not      obstruct traffic or access.
- On any public street where signage prohibits parking.

Section 4: Enforcement
1. This ordinance shall be enforced by the Kress Code Enforcement Official or any authorized personnel authorized by the Mayor.
2. Parking citations may be issued for violations of this ordinance and applicable state laws.
3. Vehicle could be towed for repeat offenders at owners’ expense. 




Section 5: Penalties
1. Any person found in violation of this ordinance shall be subject to a fine of up to $500.
2. Each day a violation continues shall be treated as a separate offense, subject to separate fines for each day of the violation.

Section 6: State Law Compliance
This ordinance shall be enforced in conjunction with all relevant state laws concerning parking. The City may also seek to enforce penalties under state laws as applicable.

Section 7: Public Awareness
The City Council shall take steps to adequately inform the public of this ordinance through signage and community outreach, including posting the ordinance on the City’s official website.

Section 8: Severability
If any provision of this ordinance is found to be invalid or unconstitutional, the remaining provisions shall continue in full force and effect.

Section 9: Effective Date
This Ordinance shall take effect immediately upon its passage and publication as required by law.
